Four in ten motorists continue to flout road rules by using their mobile phones while driving, according to a new survey.

Research by Which? found that around a third of drivers have illegally made or received a call on their handsets while driving in the past year, a further 32 per cent said they have read or sent a text message while at the wheel.

Motorists continue to disregard the rules, despite being pretty clued up on the penalties for breaking the law.

A previous survey by Which? found that around 90 per cent knew that the fine for using a handset while driving, rather than a hands-free kit was upped to three penalty points, as well as a £60 fine in February.

Richard Headland, Which? motoring editor, said: "Although people seem to be aware of the higher penalties for mobile phone use behind the wheel, many either don't understand or don't obey the revised law.

"The penalties for using a handheld phone when driving are now stiffer, but to be effective the government must change driver behaviour through better education as well as enforcement."
